Executive Directive 5105-A

Text of Directive:

  BY THE AUTHORITY VESTED IN ME AS PRESIDENT BY THE CONSTITUTION AND THE LAWS OF THE UNITED STATES OF AMERICA, INCLUDING THE NATIONAL EMERGENCIES ACT (50 U.S.C. 1601 ET SEQ.), THE ROBERT T. STAFFORD DISASTER RELIEF AND EMERGENCY ASSISTANCE ACT (42 U.S.C. 5121 ET SEQ.), AND SECTION 252 OF TITLE 10, UNITED STATES CODE (THE INSURRECTION ACT), IT IS HEREBY ORDERED AS FOLLOWS:

  SUBJECT: Declaration of a National State of Emergency and Implementation of National Continuity Procedures

  Preamble:
  In light of credible and widespread threats to the United States, including acts of sedition, coordinated attacks on federal institutions, and a conspiracy to disrupt the lawful functions of the federal government, I find that the peace and safety of the Nation are in grave jeopardy and that these circumstances constitute a national emergency. Immediate and decisive action is required to secure the continuity of our government, restore public order, and protect the life and property of the American people.

  Sec. 1. Declaration of National Emergency. A national emergency is hereby declared to exist.

  Sec. 2. Implementation of National Continuity Policy.
  (a) The National Continuity Policy, as established by Presidential Policy Directive 40 (PPD-40), is hereby implemented to ensure the continued performance of National Essential Functions.
  (b) The Secretary of Homeland Security, in coordination with the National Security Council, shall lead the interagency coordination for the execution of continuity plans. A National Continuity Policy Coordination Committee is hereby established, chaired by the Secretary, to deconflict and synchronize all federal continuity operations.

  Sec. 3. Restoration of Public Order.
  (a) Pursuant to 10 U.S.C. §§ 252-253, I find that unlawful obstructions, combinations, and assemblages of persons have made it impracticable to enforce the laws of the United States in multiple jurisdictions by the ordinary course of judicial proceedings.
  (b) The Secretary of Defense is hereby authorized to deploy and utilize such elements of the armed forces, including the federalization of National Guard units, as may be necessary to suppress insurrection and enforce federal law. These forces shall operate in support of domestic civilian law enforcement authorities wherever possible.

  Sec. 4. Protection of Critical Infrastructure and Communications Networks.
  (a) The Secretary of Homeland Security, in coordination with the Secretaries of Transportation and Energy, shall take all necessary measures to protect and restore critical national infrastructure.
  (b) The Federal Communications Commission (FCC) and the National Telecommunications and Information Administration (NTIA) are directed to implement emergency protocols to ensure the operational integrity of national telecommunications networks for official and emergency communications. Priority access for public safety and government use is authorized. Public broadcasting shall be limited to the dissemination of official emergency information through the Emergency Alert System (EAS) as directed by the Department of Homeland Security.

  Sec. 5. Emergency Authority for Law Enforcement.
  (a) The Attorney General is authorized to implement emergency procedures to ensure public safety and the swift enforcement of federal law.
  (b) In federally designated "Emergency Zones," the Attorney General is authorized to impose reasonable restrictions on the time, place, and manner of public assembly to prevent violence and civil unrest.
  (c) The Attorney General is further directed to exercise all available authorities to detain, on an emergency basis, any persons reasonably believed to have committed, or to be conspiring to commit, acts of sedition or terrorism against the United States.

  Sec. 6. Coordination with State and Local Governments. All state and local authorities are urged to cooperate fully with federal agencies in the execution of this order. Any state or local entity determined to be unable or unwilling to enforce federal law and maintain public order may be subject to the preemption of its authority by federal officials in accordance with applicable law.

  Sec. 7. General Provisions.
  (a) This order shall be effective immediately.
  (b) This order is not intended to, and does not, create any right or benefit, substantive or procedural, enforceable at law or in equity by any party against the United States, its departments, agencies, or entities, its officers, employees, or agents, or any other person.
